How the FDA & FTC work together regulating drugs


The Food and Drug Administration (FDA) and the Federal Trade Commission (FTC) are two federal agencies that work together to regulate the interstate commerce of drugs. The FDA is responsible for ensuring the safety and effectiveness of drugs, while the FTC is responsible for protecting consumers from unfair or deceptive trade practices.


The FDA has a number of requirements for drugs that are marketed in the United States.

These requirements include:

  • Drugs must be approved by the FDA before they can be marketed.

  • Drugs must be labeled accurately.

  • Drugs must be manufactured in accordance with good manufacturing practices (GMPs).

These requirements include:

  • Marketing & advertising must be truthful and not misleading.

  • Marketing & advertising must not make any claims that are not supported by scientific evidence.

  • Marketing & advertising must not target children.

  • Drugs must not be sold in a way that is unfair or deceptive.

  • Requiring drug companies to provide accurate information about their drugs

  • Drugs must not be sold to people who are not eligible to receive them.


The FDA and the FTC work together to share information and coordinate their enforcement activities. The FDA can take action against companies that violate its requirements, such as by removing drugs from the market or imposing fines. The FTC can also take action against companies that violate its requirements, such as by ordering companies to stop making false or misleading claims, or by bringing civil lawsuits, or issuing cease-and-desist orders. Their intent of enforcement is to ensure that marketed drugs are safe and effective for consumers.

Note: The definition of what is considered a drug is constantly updating and changing. Some products that have been on the market for some period of time, that were not previously considered a drug, may now be subject to regulation as a drug. These products have to comply with these regulations or risk being removed as marketed products. Check with the FDA frequently to ensure that the ingredients of products you manufacture do not contain a regulated substance.
